Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern access to and use of A+Planner, operated by Cyber Inspired LLC. By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a school or school district, you represent that you have authority to bind that organization to these Terms.

2. Who Can Use the Service

The Service is intended for use by teachers, school and district staff, and students under the direction of a school or district. Student accounts are provisioned and managed by school staff; students do not independently agree to these Terms where applicable law requires parental or institutional consent.

3. Accounts and Roles

• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• Role-based access (Teacher, Student, Support Staff, Administrator, Superintendent) determines what data and features you can access. You agree not to attempt to access data or functionality outside your assigned role.
• Passcodes used to register as Teacher, Administrator, or Superintendent are shared secrets managed by your district and must not be shared outside your organization.

4. Subscriptions, Trials, and Billing

• Individual subscriptions are billed monthly in advance and include an initial free trial period as described at checkout. You may cancel at any time; access continues until the end of the current billing period.
• District and school subscriptions are billed per the terms of the applicable order form or invoice, which take precedence over this section in the event of a conflict.
• Fees are non-refundable except as required by law or as separately agreed in writing.
• We may change subscription pricing on renewal with advance notice.

5. Acceptable Use

You agree not to:

• Use the Service to store or transmit real, identifiable student names or other data in fields explicitly designed for anonymized labels (e.g., the Student Accommodations Roster).
• Attempt to bypass role-based access controls, security measures, or usage limits.
• Use the Service to harass, defraud, or harm any person, including through the Incident Reports or Tip Line features.
• Reverse-engineer, resell, or use the Service to build a competing product.

6. Student Data and School Records

Where the Service is used to process education records subject to FERPA or similar state student-privacy laws, we act as a "school official" with a legitimate educational interest, under the direct control of the school or district with respect to the use and maintenance of those records, consistent with a signed Data Privacy Agreement between us and your school or district. 7. Content You Submit

You retain ownership of content you submit (lesson plans, reports, roster data). You grant us a license to host, process, and display that content solely to provide the Service to you and your organization.

8. Termination

We may suspend or terminate access for violation of these Terms. You may stop using the Service at any time. Upon termination of a paid subscription, we will retain data for a reasonable period to allow export, then delete it in accordance with our data retention practices and any applicable Data Privacy Agreement.

9. Disclaimers

The Service, including any AI-generated content (such as lesson plans), is provided "as is." AI-generated content may contain errors and should be reviewed by a qualified educator before use. We do not warrant that the Service will be uninterrupted or error-free.

10. Limitation of Liability

Cyber Inspired LLC — liability caps and exclusions should be set with counsel based on your business structure and insurance coverage.]

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by posting an updated version with a new "Last updated" date, and, where required, by direct notice to district administrators.
